Understanding Divorce in Australian Law

Divorce is the dissolution of a marriage. In Australia, divorce is governed by the Family Law Act 1975. Divorce is a legal process that involves formally applying to the Family Law Court. The application can be made jointly or as a sole applicant. Each of these methods has its requirements. 

A 12-month separation must precede a divorce. The parties can cohabitate during this period under certain circumstances. This is known as ‘separation under one roof’. 

Parenting and property arrangements are usually made during the divorce process.
